When you use any consumer product, you expect it to be safe and free from defects. Unfortunately, with the vast number of products on the market at any given time, that is not always the case. In the united states, millions of people are injured by defective products. Whether it's a kitchen appliance or a lawnmower, you expect it to work as advertised. If you use the product as intended and it causes a serious injury, you may be able to file a product liability claim. Since Massachusetts is a strict liability state, you don't have to prove that the product was designed, manufactured, or marketed negligently to succeed in court. In addition, you also may be able to file a negligence lawsuit under the state's Consumer Protection Act. if you can prove that the company engaged in unfair or deceptive acts.

If you suspect you are the victim or product liability it is important that you preserve the product itsself along with any packing materials and inserts that came with the product.

In Massachusetts there are three main types of defects to support a liability product claim which are:

  • Manufacturing Defects

  • Failure to Warn

  • Design Defects
